Why Hire An Estate Planning Lawyer?

byAlma Abell

There are numerous laws that come into play when you are creating your will or establishing a trust, and as such you are well advised to hire an estate planning lawyer in Santa Ana to help and guide you. For some families, a simple DIY will be enough, but for the greatest majority of people, it is important to work closely with a lawyer. When deciding whether a lawyer is needed take into account your assets, ownership of business, medical concerns and of course, your children.

Do you need help planning your estate?

The key to ensuring that your final wishes regard property distribution and your wishes regard healthcare is to work closely with an estate planning lawyer. The lawyer can help you draft your last will and testament, create a trust or help you develop a comprehensive plan that includes living trusts, healthcare provisos, tax-free gifts and more.

State laws must be followed:

Although there are minor differences, all states say what can and cannot be in a will or trust and who can and can’t serve as the trustee and what formalities must be observed when a will or trust is signed. Although there are many DIY plans available on the internet or in book stores, ask yourself if it is worth jeopardizing your estate just to save a little money. If there are mistakes made up front, it will take a lot more money after the fact to fix the errors.

What an estate planning lawyer can do:

An estate planning lawyer in Santa Ana is experienced and knows the state laws. The lawyer will discuss the state of your affairs, understand the property you own and understand your estate planning goals and the needs of those that you will leave behind. Your lawyer will lay out the options and will work alongside you to develop a plan that is tailored specifically to suit your goals.

To ensure that your estate is handled in accordance with your wishes and your family is looked after you should develop an estate plan in co-operation with an experienced estate planning lawyer in Santa Ana. You are invited to contact the Law Offices of Norman J. Homen.

Belgian terrorism suspects remain in custody as case details emerge

Wednesday, September 13, 2006

A court in Flanders prolonged the custody of 12 suspects on Thursday. Meanwhile, more details emerge in the case against alleged neo-Nazi group inside the Belgian army. They are accused of terrorism, weapons traffic and racism.

Most lawyers involved asked for their clients to be released, and will appeal the court’s decision. One lawyer said the police was being influenced politically to make the arrests now, before the elections of October 8, and that his client was more of a “immature teenager and weapons freak”. The prosecutor is calling some suspects weapons dealers, but the defence lawyers claim they are weapons collectors, and say that terrorism is out of the question.

A spokesperson for the justice department denied this formally, saying that “The weapons traffic of the suspects began to take too large proportions, so we couldn’t wait any longer.” She also said the army informed them that they considered it too dangerous to take the soldiers involved along on uncoming international missions (Belgium is sending troups to Lebanon).

The prime suspect and alleged leader of the group is Thomas B. The police thinks he has a neo-Nazistic ideology and was planning attacks to destabilise Belgium. Thomas B. founded a splinter group of Blood and Honour called ‘Bloed, Bodem, Eer en Trouw’ (Eng: Blood, Soil, Honour and Fidelity), after the British headquarters of the skinhead organisation didn’t let him found an official branch in Belgium.

T.V. station VTM claimed the police tapped into phone conversations where Thomas B. was talking about killing Filip Dewinter and Dyab Abou Jahjah, two political leaders and opponents in Belgium. That way, both sides would cause an uprise and they could seize the opportunity. But the prosecutor’s office has formally denied the existence of specific plans to this end.

The police has discovered numerous weapons, and a video showing a paramilitary training, not only on military grounds but also under a bridge in the city Dendermonde. The police say the tape shows how they fire guns and throw Molotov cocktails on that location.

In the political arena, Internal Affairs minister Patrick Dewael has suggested a law to forbid far right criminal organisations. The plan was applauded by some and contested by others. Earlier on Friday, the federal government supported the proposal to give more power to the national intelligence services to fight terrorism. Minister of Defence André Flahaut suspended 11 suspects inside the army. Prime minister Guy Verhofstadt said the entire affair was “a blame for the country and the army”.

Kennedy Center names 2007 honors recipients

Friday, September 14, 2007

The Kennedy Center announced that its 30th presentation of the Kennedy Center Honors would go to pianist Leon Fleisher, comedian Steve Martin, singer Diana Ross, director Martin Scorsese and musician Brian Wilson. The Center was opened to the public in 1971 and was envisioned as part of the National Cultural Center Act, which mandated that the independent, privately-funded institution would present a wide variety of both classical and contemporary performances, commission the creation of new artistic works, and undertake a variety of educational missions to increase awareness of the arts.

In a statement, Kennedy Center Chairman Stephen A. Schwarzman said that “with their extraordinary talent, creativity and perseverance, the five 2007 honorees have transformed the way we, as Americans, see, hear and feel the performing arts.”

Fleisher, 79, a member of the Peabody Institute‘s music faculty, is a pianist who lost use of his right hand in 1965 due to a neurological condition. He became an accomplished musician and conductor through the use of his left hand. At 67, he regained the use of his right hand. With the advent of Botox therapy, he was once more able to undertake two-hand performances in 2004, his first in four decades. “I’m very gratified by the fact that it’s an apolitical honor,” Fleisher said. “It is given by colleagues and professional people who are aware of what [an artist] has done, so it really is apolitical — and that much more of an honor.”

Martin, 62, a comedian who has written books and essays in addition to his acting and stand-up comedy career, rose to fame during his work on the American television program Saturday Night Live in the 1970’s. Schwarzman praised his work as that of a “renaissance comic whose talents wipe out the boundaries between artistic disciplines.” Martin responded to the honor saying, “I am grateful to the Kennedy Center for finally alleviating in me years of covetousness and trophy envy.”

Ross, 63, was a product of Detroit‘s Brewster-Douglass Projects when as a teeager she and friends Mary Wilson and Florence Ballardis formed The Supremes, a ground-breaking Motown act. She portrayed singer Billie Holiday in the 1972 film Lady Sings the Blues, which earned her an Oscar nomination and a Golden Globe award. “Diana Ross’ singular, instantly recognizable voice has spread romance and joy throughout the world,” said Schwarzman. Ross said she was “taken aback. It is a huge, huge honor and I am excited to be in this class of people.”

Scorsese, 64, is one of the most accomplished directors the United States ever produced, whose work includes Mean Streets, Taxi Driver, GoodFellas, Cape Fear, The Last Temptation of Christ and The Departed, for which he won a 2006 Academy Award for Best Director after being nominated eight times. Scorsese said, “I’m very honored to be receiving this recognition from the Kennedy Center and proud to be joining the company of the very distinguished individuals who have received this honor in years past.”

Wilson, 65, along with his brothers Dennis and Carl, formed the Beach Boys in 1961. They had a series of hits that included “Surfin’ U.S.A.” and “Wouldn’t It Be Nice.” Their 1966 album Pet Sounds is considered one of the most influential recordings in American music. “This is something so unexpected and I feel extremely fortunate to be in the company of such great artists,” said Wilson, who is currently on tour.

The Kennedy Center’s board of trustees is responsible for selecting honorees for “lifetime contributions to American culture through the performing arts.” Previous honorees, including Elton John and Steven Spielberg, also submitted recommendations. A wide variety of people were under consideration, including Emanuel Ax, Evgeny Kissin, Renee Fleming, Laurence Fishburne, Francis Ford Coppola, Melissa Etheridge and Kenny Chesney.

President Bush and first lady Laura Bush will attend the center’s presentation at its opera house on December 2, 2007, which will broadcast on December 26 on CBS.

Why Hire A Tampa Brain Injury Lawyer?

Find Out More About:

 • Excavator Hire
 • Excavator Auckland

byAlma Abell

Those who have been in an accident that resulted in brain injuries often suffer effects that last a lifetime. Besides medical bills, the future earnings of the victim may be limited or reduced to zero due to the brain injury. In many instances, there may be pain and suffering as well. Although some victims and their families often try to settle directly with the insurance company of the responsible party, this often results in settlements that are worth far less than compensation earned with legal counsel even after accounting for the lawyer’s fees and expenses. That is why victims of brain injuries should seriously consider hiring a Tampa brain injury lawyer.

Once brain injuries occur, the effects are often permanent. For example, brain cells undergo a process that results in cell death after a few minutes without oxygen. Even if oxygen is restored to the victim, the chemical changes that occur in the brain may not be reversible. In most personal injury cases, lawyers wait until the victim’s physicians declare that modern medicine has achieved maximum healing with little chance for improvement. Although the same thing applies to brain injuries, it is often unlikely for patients to recover even though it is still possible for a few patients to achieve partial recovery. As more time passes, the likelihood of improvements with brain injuries decreases.

Even if the Tampa brain injury lawyer is able to prove that the defendant was negligent, it is also necessary to show that the injuries were a result of the defendant’s negligent actions or inaction. With brain injuries, it is rare that defense attorneys can attribute the condition to some other accident or medical condition. However, good brain injury attorneys always need to be ready if the defense chooses to challenge the cause of the injury. Because this type of case can involve large financial settlements, injury attorneys won’t assume anything.

Eventually, most cases are settled out of court. This does not mean it is OK for the injury attorney to not prepare for trial. The insurance company will not pay a fair settlement until the victim has prepared for a jury trial that may result in large financial losses. That is why a victim who wants a fair settlements needs to hire legal counsel. To learn more about brain injury attorneys and what they can do, browse site for more information.

Lansing, Michigan airport designated ‘aerotropolis’

Saturday, December 24, 2011

On Wednesday the Lansing, Michigan Capital Region International Airport and surrounding land was designated as an “aerotropolis” by the Michigan Economic Development Corporation Strategic Fund board. The Next Michigan Development program allows the airport to offer tax incentives in order to attract manufacturing, distribution, and technology businesses to the surrounding area.

Incentives can include property tax abatements or the elimination of most state and local taxes for a specified period of time. To qualify for the incentives, a company would have to start a new venture on airport property or expand an existing one. Additionally, companies need to use a minimum of two out of four transportation modes – freight, air, rail, or water.

The airport, in DeWitt Township, is the second in Michigan to receive an aerotropolis designation. The state’s other aerotropolis is located in the area surrounding Detroit Metropolitan and Willow Run airports. In October the city of Lansing and DeWitt Township approved a 425 tax-sharing agreement on the property, designating approximately 850 acres (344 ha) of land as available for future development.

Estate Planning Services From An Accountant In Manhattan

Find Out More About:

 • Investment Property Advice
 • Property Advisor

byAlma Abell

It’s not surprising that when someone thinks about hiring an Accountant in Manhattan, they primarily think about hiring a professional to handle business or individual tax filings. While this is certainly a big reason why people hire accountants, an accountant can help in many other ways. One way that these financial professionals can be extremely beneficial is when someone is actively planning their estate.

Estate Planning and Taxes

There are many facets of estate planning, from investing money to documenting who will become the executor of the estate when the owner of that estate passes away. However, tax issues can be a significant part of estate planning and, often times, the best person to advise an individual when it comes to taxes is an accountant.

For example, if a person wishes to leave gifts for people before they pass away, this can help reduce the tax burden on the individual receiving those gifts, especially if they are in line to gain something from the estate after the owner has passed away. In addition, minimizing debt is a huge issue when it comes to estate planing.

Getting out of Debt

An accountant can work with the estate owner to help manage loan repayment schedules. In some cases, an accountant can help the estate owner understand the benefits of accelerating loan repayments so that when they pass away, few, if any, financial resources will have to go towards paying off existing creditors. In these cases, most of the financial resources of a person’s estate can be disseminated among the estate’s beneficiaries, free from debt.

This type of planning, while perfect for estate planning, is also a good idea for an individual looking to get their personal or family finances in better shape. Many times, an accountant can not only handle tax issues, but they can also help their clients to be better regimented with money, to follow a clear budget, and to work to get out of debt.

An Accountant in Manhattan offers a number of benefits, which is why so many individuals and businesses use personal and business accountants on a regular basis. If you’d like to know more about what personal accountants can offer you, you may want to check out a website like Rawcpa.com.

Battle for Trafalgar Square, London as violence breaks out between demonstrators and riot police

Monday, March 28, 2011

Sunday morning showed Trafalgar Square, London damaged during the night by demonstrators.

Bottles, cans, and placards littered the concrete ground of one of the most iconic landmarks in London. Demonstrators livid at government cuts had sprayed graffiti on the four bronze lions. “No-one rules if no-one obeys,” one message, next to the symbol of anarchy, read. On the steps leading up to the National Gallery lay placards, dropped by demonstrators the night before. Hours earlier the square was an arena for running battles between the anarchist protesters and riot police.

First, they targetted Oxford Street, arguably the most famous shopping row in the city. The protesters, many dressed in black, hurled smoke bombs and paint at Topshop, which they claimed has systematically abused the tax system. In Piccadilly, they ransacked The Ritz, a hotel popularly known for upmarket opulence. As darkness fell over the capital, many went home. But in Trafalgar Square, protesters lit campfires and danced to music, smoking and eating into the night.

But then the police moved in. Clad in riot gear, the situation began to escalate and both they and the demonstrators began to panic. They raised their batons and shouted at the crowd, while the protesters grabbed metal barriers and hurled them over police lines, using them as battering rams. Some protesters yelled in defence, “Don’t hit us!”, while the more determined shouted, “Shame on you! Your job’s next!” The riot officers pushed protesters into the centre of the square, towards Nelson’s Column. The police started forward at least twice swinging their batons in the air, as protesters retaliated by throwing glass bottles and coins towards the police lines. One officer was taken away with blood pouring from under his visor.

“I have never seen such a fast escalation of violence in my life,” one witness to the violence in the square said. “Everything just kicked off, glass everywhere, police hitting people, people being dragged across the floor. I just can’t believe it.” Other protesters on the front line later described the police retaliation as they began to kettle people in. “I find myself in front of the riot line,” one protester wrote, “taking a blow to the head and a kick to the shin; I am dragged to my feet by a girl with blue hair who squeezes my arm and then raises a union flag defiantly at the cops.”

Everything just kicked off, glass everywhere, police hitting people, people being dragged across the floor. I just can’t believe it.

Fireworks exploded overhead and, towards midnight, the number of protesters had diminished. As the kettling began, many of them slipped away into the night. In the early hours of the morning, the levels of violence began to fade. “Vandalism has been committed and officers have come under sustained attack,” the Metropolitan Police said. “We are holding everyone here until the situation calms down and we determine who is responsible.”

As the street cleaners worked through the morning in London, more than 200 protesters, detained throughout the day, remained in custody. Although the organisers of the march were swift to disassociate themselves with the violence, the protesters were defiant. “I’m not moving, I’m not moving,” one young protester, hemmed in by the riot police, said. “I’ve been on every protest, I won’t let this government destroy our future without a fight. I won’t stand back, I’m not moving.”

California senator opposed to cell-phones involved in cell-phone related crash

Tuesday, May 22, 2007

California state senator Carole Migden crashed her state provided SUV into a Honda sedan while reaching for her phone. Migden has favored a new law penalizing drivers who talk on their cellular phones (aka mobile phones).

The crash occurred on Highway 12 in Solano County, California Friday morning. The driver of the Honda was taken to a near-by hospital for minor injuries.

In 2006, Migden voted to fine drivers a minimum $20 fee for driving while talking on the phone without a hands-free device. The law will not go into effect until July 2008, so she will not receive a fine for using her phone. She said that she has taken full responsibility for the accident.

The California Highway Patrol (CHP) is now looking into reports of another accident involving Midgen.

“We’re getting information now from the officers following up this morning that there was a second accident involving the center divider. Witnesses have her driving to the left of the number one lane and brushing against the guardrail,” said Marvin Williford, spokesperson for the CHP in the Solano area.

Supporters of Myanmar’s Suu Kyi mark detained leader’s 62nd birthday

Tuesday, June 19, 2007

Aung San Suu Kyi, the detained leader of the National League for Democracy in Myanmar marked her 62nd birthday today, still under house arrest, where she has spent most of the past 17 years.

About 250 supporters met at the National League for Democracy (NLD) headquarters in Yangon, not far from Suu Kyi’s home, and held a rally calling for her release. Doves and balloons were released into the air, under the watchful eyes and video cameras of around 50 plainclothes police officers, who were stationed across the street.

The police force was augmented by a dozen truckloads of members of the Union Solidarity and Development Association, the political arm of the State Peace and Development, the junta that rules Myanmar.

“The doves symbolise peace. We also released colourful balloons, which rise like her prestige when they fill the sky,” NLD women’s wing leader Lai Lai was quoted as saying by Agence France Presse.

With the party marking marking Suu Kyi’s birthday as “Myanmar Women’s Day,” Lei Lei read out a statement at the ceremony, calling Suu Kyi “irreplaceable” and praising her “honesty, bravery and perseverance.”

Security was beefed up around Suu Kyi’s lakeside home on University Avenue, which is usually open to traffic during daytime, but is closed on significant anniversaries such as Suu Kyi’s birthday or the May 30 anniversary of her detention.

NLD supporters said police were also watching their homes.

“Plainclothes police circled around my house on their motorcycles last night until dawn,” Su Su Nway, 34, was quoted as saying by Agence France-Presse. She was arrested on May 15 with 60 others during a prayer rally for Suu Kyi in Yangon, and was released for health reasons on June 7. She said around 52 NLD supporters were still in custody.

Suu Kyi is generally barred from receiving visitors, so she spent the day alone. Except for her maid, a personal physician, a dentist and an eye specialist, the only other person to visit with Suu Kyi in the past year was United Nations Undersecretary-General for Political Affairs Ibrahim Gambari, whom she met for one hour last November at a government guest house.

Winner of the 1991 Nobel Peace Prize, Suu Kyi has been under house arrest for 11 of the past 17 years, continuously since 2003. Her National League for Democracy won a landslide election in 1990, but the military, which has ruled Myanmar since 1962, refused to honor the results. The country is also known as Burma, but the military government renamed it Myanmar in 1989.

Calls for Suu Kyi’s release have been issued by the NLD, various world bodies and other countries, but the pleadings have been met by no response from the generals.

“In our view, until their constitution is ratified, she will not be released,” Sann Aung, a Bangkok-based leader of the Burmese government-in-exile was quoted as saying by Reuters.

“They are worried that she will be a threat to the National Convention and the referendum,” he told Reuters, referring to the planned national referendum on a new constitution that is being written by the generals.

The Nation newspaper in Bangkok marked Suu Kyi’s birthday with an editorial, saying that sanctions against the Myanmar regime have been ineffective.

“The junta has earned huge amounts of foreign revenue from oil and gas exports, with prices jacked up many times over. With rich mineral resources, energy hungry countries have been attracted to Burma despite the repressive nature of the junta,” the editorial said, also making note of a recent deal that Russia has made to build nuclear reactor in Myanmar.

The paper also said Myanmar bodes ill for the 10-member Association of Southeast Asian Nations regional grouping.

“As long as Aung San Suu Kyi remains incarcerated, ASEAN’s reputation and the group’s international standing will be tarnished. Asean leaders have repeatedly appealed to the Burmese junta to free her, but to no avail … today, Burma is the black sheep of ASEAN. Without any current provisions for sanctions, Burma will remain as intransigent in the future as it is today.”
