Top broker and Wall Street adviser Bernard L. Madoff, aged 70, was arrested and charged by the FBI on Thursday with a single count of securities fraud, also known as stock fraud and investment fraud. He allegedly told senior employees of his firm on Wednesday that his $50 billion business “is all just one big lie” and that it was “basically, a giant Ponzi scheme (since at least 2005).” Mr. Madoff faces up to 20 years imprisonment and a fine of up to $5 million. FBI agent Theodore Cacioppi said Mr. Madoff’s investment advisory business had “deceived investors by operating a securities business in which he traded and lost investor money, and then paid certain investors purported returns on investment with the principal received from other, different investors, which resulted in investors’ losses of approximately $50 billion dollars.”

The former chairman of the Nasdaq Stock Market is also the founder and primary owner of Bernard L. Madoff Investment Securities LLC, the closely-held market-making firm he launched in 1960. The firm is one of the top market maker firms on Wall Street. He founded his family firm with an initial investment of $5,000, after attending Hofstra University Law School. He saved the money earned from a job lifeguarding at Rockaway Beach in Queens and a part time job installing underground sprinkler systems.

A force in Wall Street trading for nearly 50 years, he has been active in the National Association of Securities Dealers (NASD), a self-regulatory organization for the U.S. securities industry. His firm was one of the five most active firms in the development of the NASDAQ, having been known for “paying for order flow,” in other word paying a broker to execute a customer’s order through Madoff. He argued that the payment to the broker did not alter the price that the customer received. He ran the investment advisory as a secretive business, however.

Dan Horwitz, counsel of Mr. Madoff, in an interview, said that “he is a longstanding leader in the financial-services industry with an unblemished record; he is a person of integrity; he intends to fight to get through this unfortunate event.” Mr. Madoff was released on his own recognizance on the same day of his arrest, after his 2 sons turned him in, and posting $10 million bail secured by his Manhattan apartment. Without entering any plea, the Court set the preliminary hearing for January 12.

Madoff’s hedge fund scheme may rank among the biggest fraud in history. When former energy trading giant Enron filed for bankruptcy in 2001, one of the largest at the time, it had $63.4 billion in assets. The scheme would dwarf past Ponzis, and it would further be nearly five times the telecommunication company WorldCom fraud and bankruptcy proceedings in 2002.

The Securities and Exchange Commission filed a separate civil suit on Thursday against Bernard L. Madoff Investment Securities and its eponymous founder Mr. Madoff. It was docketed as “U.S. v. Madoff,” 08-MAG-02735, by the U.S. District Court for the Southern District of New York (Manhattan). SEC, New York associate director of enforcement, Andrew M. Calamari, asked the judge to issue seizure orders on the firm and its assets, and appoint a receiver. The SEC pleads, among others, that “it was an ongoing $50 billion swindle; our complaint alleges a stunning fraud that appears to be of epic proportions.” It further accused the defendant of “paying returns to certain investors out of the principal received from other, different investors” for years. Madoff’s hedge fund business had previously claimed to have served between 11 and 25 clients and had $17.1 billion in assets under management. But virtually all of the assets were missing.

United States District Court for the Southern District of New York Louis L. Stanton on Thursday appointed Lee Richards, a Manhattan lawyer, as the firm’s receiver. A hearing is set for Friday, for a ruling on the SEC’s petition to grant plenary powers to the receiver over the entire firm, and an absolute asset sequestration.

Doug Kass, president of hedge fund Seabreeze Partners Management said that “this is a major blow to confidence that is already shattered — anyone on the fence will probably try to take their money out.”

National Parties

In the lead-up to the 2008 Canadian federal elections much speculation was made about environmental issues and initiative, with various parties maneuvering to claim some portion of the green mantle. But it was the Liberal party which first brought a full-blown policy to the public.

In the months since the Green Shift initiative was brought forth, the political pundits and activists have both talked about this year as the first election where the environment would be a major issue on the minds of voters, and possibly a decisive one for the electorate.

It’s indeed true the environment ranks very high in minds of voters across the country, particularly among young voters. One national survey of Canadians between 18 and 25 finds the environment is the top issue. A poll of all voters found it to be the third most important single issue over all, behind the economy and health care, but the poll suggested that no one issue has really caught the attention of the electorate with many issues gaining similar attention.

The parties themselves seem indecisive, trying to claim a focus on environmental issues but rarely making specific proposals or promises, with the notable exception of the Liberals whose platform has been targeted by opponents and commentators as “wildly experimental” and “doesn’t go deep enough” by turns.

Examining the platforms of the New Democratic Party regarding air pollution and global warming as available on their website, one is struck by a lack of substance. Reference is made to C-377, the Climate Change Accountability Act, which the NDP calls “Layton’s Kyoto-Plus Bill”, which was passed in 2006. The party believes Canada can achieve its Kyoto requirements by 2012, though no mention is made of how a Layton government would do so.

In June of 2008 the Liberals tabled a plan, the Green Shift, which they claim would reduce Canada’s greenhouse gas emissions 20% under 1990 emissions – well below the 6% required by Canadian law when Canada ratified the Kyoto Accord – by 2020, which is rather after the 2008-2012 phase-in period required by that same law. The method of performing this reduction would be to shift the Canadian tax system, reducing income and revenue taxes by replacing them with taxes on greenhouse gas emissions. The plan generated considerable discussion and opposition, and the party has back-pedaled in some portions and added on in others, as well as announcing a couple of separate initiatives to soften the effects for farmers, homeowners, and fishermen among others.

A more diverse approach than solely a “Carbon Tax” is proposed in the Green Party’s platform, which presents an almost holistic approach of adherence to the Kyoto obligations, “Cap and trade” of carbon emissions, industry development with both green technology R&D and regulation as well as consumer subsidies, and their own version of a carbon tax. Alone of the parties they specifically mention the role of international diplomacy/trade as a part of their approach.

Such an approach appears to be anathema to the Conservatives, whose mantra since their election has been that Kyoto cannot be complied with without forcing an economic recession on the country, and used the Throne Speech of 2007 to reiterate that position. They have opposed cap-and-trade schemes in the past, but their platform for this election states their plan to reduce greenhouse gas emissions includes emissions caps for “four air pollutants commonly associated with smog and acid rain,” as well as “tough emission reduction targets”.

In contrast to the laundry-list of unconnected initiatives on the Conservative’s website, the clean platform pamphlet created by the Bloc Québécois makes a simple and apparently heartfelt statement on the environment:

Tackling climate change has become a fundamental issue for all of humanity and Québec is determined to make its contribution, in its own way. In Ottawa, the Bloc Québécois, respecting Québec’s choices, is leading the fight to enforce the Kyoto Protocol.

Just how they plan to enforce the Kyoto obligations is not stated, though they do discuss a carbon market, and tax incentives for home heating upgrade and transportation.

There seems to be a wide if somewhat shallow interest in the electorate as to just what each party is offering on the environmental file. But with sketchy platforms regarding environmental issues, it’s no wonder some of the parties have turned to the subject of economics in recent days.

ACLU commemorates anniversary of US Supreme Court decision on student free speech

On Tuesday, the non-profit organization the American Civil Liberties Union (ACLU) released a video and press release commemorating 40 years since the landmark Supreme Court of the United States decision involving freedom of speech in the case Tinker v. Des Moines Independent Community School District. The Tinker case was decided on February 24, 1969. The case involved students in Iowa who chose to wear black armbands with peace symbols in protest of the Vietnam War – in violation of a recent school board policy. In their statement, the ACLU compared issues of freedom of speech in the Tinker case to a more recent case, Gillman v. Holmes County School District, where a school district in Florida forbade students from wearing rainbow symbols in school in support of LGBT rights.

In the Tinker case, John and Mary Beth Tinker and another student decided to wear black armbands with peace symbols to school in protest of the Vietnam War. The school district heard of the students’ plans and decided to ban armbands in school. The three students case were represented by the ACLU of Iowa, and in a 7-2 decision the Supreme Court ruled for the plaintiffs.

It can hardly be argued that either students or teachers shed their constitutional rights…at the schoolhouse gate.

Supreme Court Justice Abe Fortas wrote in the Opinion of the Court: “It can hardly be argued that either students or teachers shed their constitutional rights…at the schoolhouse gate.”

The Gillman case began in September 2007 when according to students at Ponce de Leon High School in Florida, school officials responded improperly to complaints from a lesbian student that she was being harassed by other students. The ACLU contacted the school district on behalf of junior Heather Gillman, inquiring what form of symbols or slogans relating to LGBT rights would be allowed.

The school district responded saying it would not allow any expression of the sort, because it would “likely be disruptive”, and said the wearing of these types of symbols by students could signify they were part of a “secret/illegal organization”.

The video released by the ACLU includes clips of a deposition given by David Davis, the principal of Ponce de Leon High School in Florida. Davis testified he decided to ban students from wearing rainbow symbols in school because the rainbow is a symbol of “gay pride”, and he said it “could hinder the educational process”. He also testified that these symbols would immediately cause students viewing them to think of homosexual sex. Heather Gillman commented in the ACLU video “It was kind of scary, kinda, because I didn’t know what people would think, but then I figured ‘Who cares what people think, I’m standing up for something I believe in.'”

On May 13, 2008, a federal judge decided in favor of the plaintiff, and permanently enjoined the school district from infringing upon the First Amendment rights of the students. Matt Coles, director of the ACLU’s national LGBT Project, stated “Schools need to know censorship is illegal, and students need to know their schools can’t get away with it.”

I’m grateful that the precedent established by the Supreme Court 40 years ago is still protecting students, including LGBT students and their friends.

In reflecting on the use of the Tinker precedent in the Gillman case, the ACLU cited three instances in which schools “were made to stop illegally censoring students thanks to Tinker v. Des Moines.” These include a 2006 incident where a student in Ohio was instructed by school administrators to remove a t-shirt which read “I support gay marriage”, and a 2007 incident where a teacher and an assistant principal at a school in Virginia told a student she could not wear a t-shirt with overlapping female gender symbols. In both cases the ACLU represented the students and school officials backed down and apologized for their actions.

In a blog post Tuesday by Mary Beth Tinker at Daily Kos, Tinker reflected on the similarities between her case before the Supreme Court of the United States and the more recent federal case of Heather Gillman. “I’m grateful that the precedent established by the Supreme Court 40 years ago is still protecting students, including LGBT students and their friends,” wrote Tinker. She encouraged young people to speak out about issues of concern to them and to freely express their thoughts and views. Tinker is currently a nurse in Washington, D.C., and travels the United States speaking to students about their First Amendment rights.

China overtakes Germany as world’s biggest exporter

Chinese officials have said that their country’s exports surged last December to edge out Germany as the world’s biggest exporter.

The official Xinhua news agency reported today that figures from the General Administration for Customs showed that exports jumped 17.7% in December from a year earlier. Over the whole of 2009 total Chinese exports reached US$1.2 trillion, above Germany’s forecast $1.17 trillion.

Huang Guohua, a statistics official with the customs administration, said the December exports rebound was an important turning point for China’s export sector. He commented that the jump was an indication that exporters have emerged from their downslide.

“We can say that China’s export enterprises have completely emerged from their all-time low in exports,” he said.

However, although China overtook Germany in exports, China’s total foreign trade — both exports and imports — fell 13.9% last year.
