Don Imus reaches settlement with CBS, sued by Rutgers member

Tuesday, August 14, 2007

Don Imus has reportedly reached a settlement with CBS and is now negotiating with New York’s WABC radio for a job there.

CBS spokesman Dana McClintock said Imus and CBS Radio reached a settlement to pre-empt Imus’ threatened $120 million breach-of-contract lawsuit.

Martin Garbus, Imus’ lawyer, and CBS Radio issued a joint statement, saying “[Imus and CBS Radio] have mutually agreed to settle claims that each had against the other regarding the Imus radio program on CBS,” but did not release any specific details about the settlement.

Imus was fired from both CBS radio and MSNBC in April after using the phrase “nappy headed hos” when describing the Rutgers women’s basketball team.

CBS and MSNBC argued Imus’ remark was racist and sexist. Meanwhile, Imus’ attorney cited a clause in his contract that said CBS acknowledged that Imus’ services were “unique, extraordinary, irreverent, intellectual, topical, controversial.”

On the same day, Imus was sued by Kia Vaughn, a Rutgers team member. That suit also named NBC and CBS as defendants. The suit alleges libel and seeks monetary damages as of yet unannounced.

On November 29th, 2010, three Main United States Trucking Associations, representing in excess of 3,000 privately managed fleets, submitted an important motion with the United States Court of Appeals to be able to evaluate the implementation of this FMCSA’s Comprehensive Safety Analysis (CSA) 2010 legislation. The Carrier Lobbyist Associations are seeking a permanent injunction on the Federal Motor Carrier Safety Administration’s discharge of the contentious carrier safety scores as laid out in the FMCSA’s contentious safety legislature.

These Truck Carrier Associations had been previously declined a temporary termination order to stop implementation of CSA 2010 safety scores to the general public, while all these three thousand in addition privately owned fleets had submitted the very injunction on December 10, 2010. The Federal Court has agreed to issue an expedited deliberation to hear arguments coming from each party for the merit to giving this injunction from the Federal Motor Carrier Safety Administration (FMCSA) in the release of this Comprehensive Safety Analysis statistics within the CSA 2010 initiative.

A Few Freight Carrier Associations looking for the injunction are the Expedited Alliance of North America (TEANA), the Air & Expedited Motor Carrier Association (AEMCA), and also the National Association of Small Trucking Companies (NASTC). As a group, all these three Trucking Associations are generally opposing the implementation of Comprehensive Safety Analysis (CSA) stats arguing that the Federal Motor Carrier Safety Administration (FMCSA) does not fully understand the huge effect the release of this driver safety information will have about the small carriers.

Under the Federal Motor Carrier Safety Administration (FMCSA) regulation, the Comprehensive Safety Analysis 2010 (CSA 2010) is likely to make all reports open to the public. These records does not just report every citation, warning, safety incident, accident, and also out of service orders to everyone for each Carrier, but also for each and every truck driver. The Federal Motor Carrier Safety Administration will work with just about all regulating agencies to supply a complete and comprehensive report encompassing the Behavioral Analysis and Safety Improvement Categories (Referred to by the Federal Motor Carrier Safety Administration as BASICs).

The BASICs classifications are comprised of the subsequent requirements for each and every freight carrier as well as truck driver: unsafe driving, driving when fatigued, drivers unfit to operate a commercial vehicle, operation of a vehicle while impaired due to alcohol or drugs, improper maintenance, and collision instances experience. These trucking organizations have offered arguments that the Federal Motor Carrier Safety Administration (FMCSA)’s release of this Comprehensive Safety Administration records.

The Truck Rental Business continues to be debating the issue of vicarious liability for several years. When a party is caring for your behalf (known or unknown), vicarious liability is created by either an action or non-action. Even if the Federal Motor Carrier Safety Administration controls carriers, freight brokers, logistics companies, and shippers as a shipper from the motor carrier (whether directly or indirectly) can be located vicariously liability or disregard whenever finding a freight carrier or trucker.

Numerous ground breaking instances have already been skillfully presented and damages or injuries awarded coming from companies which didn’t have direct influence in the selection of the company. The three trucking associations seeking this injunction against the release of Comprehensive Safety Analysis (CSA) statistics from the Federal Motor Carrier Safety Administration (FMCSA): Expedited Alliance of North America (TEANA), the Air & Expedited Motor Carrier Association (AEMCA), and also the National Association of Small Trucking Companies (NASTC) and several others are nervous that freight brokers, logistics companies freight forwarders, intermodal carriers, warehousing firms, as well as shippers will certainly feel compelled to choose mainly freight carriers and truck drivers together with only the best safety scores for concern with extra liability by an improper freight carrier or owner operator decision.

In 2004, a Maryland court verdict held a third party logistics corporation liable for the negligent hiring of a trucking company which caused a major accident because the firm failed to take the Federal Motor Carrier Safety Administration (FMCSA) safety rating of the freight carrier into account before hiring the trucking company (Shramm vs. Foster).

This hot button issue of this new legislature will unquestionably continue into 2011. For now the three trucking associations have failed to prove damages brought on by the CSA 2010 initiative. The court has decided arguments offered on behalf of the 3,000 freight carriers thus far have already been ruled to be predicted or forecasted, damages, not actual damages. Thus the courts have consistent upheld the Federal Motor Carrier Safety Administration’s (FMCSA) governance over the issue. Time will tell if the trucking industry are going to be successful in displaying damages as a direct result of the Federal Motor Carrier Safety Administration?s (FMCSA) latest Comprehensive Safety Analysis legislation known as CSA 2010.

Canada to legalise marijuana to ‘make it more difficult for kids to access’

Sunday, April 16, 2017

In order to put the cannabis drug (marijuana) out of reach of minors, the Canadian federal government announced a bill to legalise cannabis for the age group of eighteen and above, on Thursday. The bill would allow adults to possess cannabis publicly, previously a criminal offence.

Canada’s health minister Jane Philpott tweeted, “Today we tabled new legislation to legalise, strictly regulate, and restrict access to cannabis. Our goal: keep it out of the hands of youth, and profits out of the hands of criminals.”((fr))French language: Ajd nous avons déposé un nouveau projet de loi pour légaliser le cannabis, le réglementer de manière stricte et en restreindre l’accès. Notre objectif: garder le cannabis hors de la portée des jeunes, & les profits hors des mains des criminels. The Canadian government, via their official website, explained cannabis is available illegally, and their measures to stop it did not work. Criminal organisations are making money selling cannabis. Under-aged people can obtain the drug easily; they said, “it is easier for our kids to buy cannabis than cigarettes.”

The bill allows provinces and territories to set the age limit above eighteen. In order to prevent criminal gangs from making a profit, selling the drug needs a license permitting its sale. Adults can purchase the drug online from a licensed producer if a retail shop is not available in the province.

Adults can carry up to 30 g (slightly over an ounce) of cannabis and grow at most four cannabis plants at home, for personal use. The plants should be no taller than a metre, the bill proposed. Selling cannabis to minors would be a specific criminal offence.

The legislation requires parliamentary approval and royal assent. If passed, the bill would be under effect by July 2018, the government said. Health and safety experts and law enforcement were consulted before proposing the legislation. Except for medical purposes, possession of the drug remains illegal until the bill is passed. Regardless of the status of the bill, import and export of the drug would be illegal.

Previously when the government increased the taxes on cigarettes to discourage citizens from smoking, a black market for cigarettes developed.

Along with legalising cannabis, the bill would also permit the police officials to use tools like oral fluid drug screeners to detect if drivers are under the influence of the drug. Zero tolerance against drivers under influence of drugs is proposed. The government would also implement a public awareness campaign on the perils of driving under the influence of drugs.

The government still working on the restrictions. Lawmaker and former police chief Bill Blair said, “We do accept that more important work remains to be done.” If the bill is passed, Canada would be the second country to legalise cannabis completely. Uruguay is the first. Some countries, such as Germany, allow medical use of cannabis, but recreational use is prohibited.

Chile’s President-elect’s battle with delinquency becomes personal

Saturday, February 27, 2010

Late on Thursday, at approximately 21:20 local time, the home of Cristián Larroulet, the nominated Ministry General Secretariat of the Presidency under President-elect Sebastián Piñera of Chile, was burglarized while his wife and son were home alone. Two suspects physically assaulted them, before making off with valuables.

Future Ministry Larroulet lives in the Santiago commune of Las Condes. Two subjects, presumed to be teenage delinquents, were surprised to find Larroulet’s wife, María Isabel Philippi, and son, Matías (aged twenty), on the premises. The two suspects, who used metal beams as weapons, proceeded to tie up their two victims with shoe laces, and assault them. Within ten minutes the suspects, whom the Chilean media describes as “anti-socials”, rampaged the home, leaving with jewelry, electronics including a laptop and an iPod, and other items.

Piñera arrived at the home at 00:10 hours on Friday in solidarity and support of Larroulet and his family. Both the identity and whereabouts of the two suspects is unknown at this time. The Chilean Carabineros (the uniformed national police) of the OS-9 force will continue with a full investigation. Larroulet stated on Friday morning that both his wife and son are in good condition following what he described as a “very raw experience.”

In the 1990’s, Chile’s crime rate was below that of the United States. In the past decade, however, Chileans have experienced an increase in violent burglary crimes, which are currently rated as moderate to high. One of Piñera’s main campaign promises was to combat crime in Chile, having posted billboards throughout the country reading, “Delinquents, your party is over.” Larroulet has criticized the politics directing citizen security under the current government party, the Concertación, stating, “I have no doubt that those governing the Concertación are missing a clearer political determination for combating delinquency,” adding “the importance is in condemning these acts and voice that combating delinquency is a priority for all Chileans.”

Death toll from tsunami in Southeast Asia increases

Thursday, October 1, 2009

A tsunami that was generated in the South Pacific by a powerful undersea earthquake has killed at least 110 people, according to authorities.

The majority of the fatalities occurred in Samoa, where rescue workers say at least 84 people were killed. Another 24 people are confirmed dead on American Samoa, while at least seven fatalities have been reported in nearby Tonga.

The US Geological Survey says an 8.0 magnitude earthquake struck early Tuesday local time. It generated waves that devastated coastal areas, knocked down buildings and sent cars floating out to sea.

Strong aftershocks followed the initial earthquake, with at least one measuring a magnitude 5.6. Tsunami alerts were issued for the entire South Pacific region but were later canceled. Survivors fled to high ground and stayed there for hours.

Several villages were destroyed on the southern Samoan coast of Upolu, which is also home to many tourist resorts.

During a flight on from Auckland, New Zealand to Apia, Samoa, Samoan Prime Minister Tuilaepa Sailele Malielegaoi told reporters he was shocked by the disaster. “So much has gone. So many people are gone. I’m so shocked, so saddened by all the loss.”

“The situation is very bad,” said Marie-Francoise Borel, a spokesperson for the International Red Cross, to the CTV News Channel by telephone. “This massive wave has swept across – it’s destroyed villages, it’s destroyed homes, people are in shock.”

The assistant chief executive of Samoa’s disaster management predicted that the death toll in the country could surpass one hundred, saying that searches for bodies in the region are still ongoing.

“They are still continuing the searches for any missing bodies in the area. Some areas have been flattened and the tsunami had brought a lot of sand onshore, so there have been reports the sand has covered some of the bodies. So we need specialised machines to search for bodies that are buried under the sand,” he said.

The communications head for the International Federation of the Red Cross, Jason Smith, told the Al Jazeera news agency that the Red Cross “[…] is working hard through five evacuation centres to provide people with safe places to stay and access to clean water,” estimating that up to 15,000 people in sixty villages were affected by the tsunami.

At the capital of American Samoa, Pago Pago, the tsunami measured 1.57 meters in height. The superintendent of the National Park of American Samoa Mike Reynolds reported four waves as high as six meters. People who experienced the quake said it was long, lasting from 90 seconds to three minutes.

We’re focused on bringing in the assistance for people that have been injured, and for the immediate needs of the tens of thousands of survivors down there.

Pago Pago city streets were strewn with overturned vehicles, cars, and debris. Some buildings located only slightly above sea level were completely destroyed by the waves, and power in some locations is not expected to be restored for up to a month. FEMA administrator Craig Fugate said that “we’re focused on bringing in the assistance for people that have been injured, and for the immediate needs of the tens of thousands of survivors down there.”

“The first federal team members are currently en route to American Samoa aboard a Coast Guard plane and will be providing on the ground assessments once they arrive on the island,” Fugate said. “FEMA, who has provisions pre-positioned in a distribution center in Hawaii, is also preparing to send supplies as needed to help meet the immediate needs of the survivors.”

Didi Afuafi, 28, who was riding on a bus in American Samoa when the tsunami struck, described her experiences. “I was scared. I was shocked. All the people on the bus were screaming, crying and trying to call their homes. We couldn’t get on cell phones. The phones just died on us. It was just crazy,” she said. “This is going to be talked about for generations.”

US President Barack Obama declared a major disaster in American Samoa, and has sent federal aid to support local recovery efforts in the US territory.

“My deepest sympathies are with the families who lost loved ones and many people who have been affected by the earthquake and the tsunami,” Obama said. He had earlier pledged in a written statement to give a “swift and aggressive” government response to the disaster.

“I am closely monitoring these tragic events, and have declared a major disaster for American Samoa, which will provide the tools necessary for a full, swift and aggressive response,” Obama said.

During a Wednesday appearance near Washington, D.C., the president said the US was ready to help its “friends” in neighboring Samoa and throughout the region.

In Tonga, seven people were confirmed dead and another three missing, after waves struck Niuatoputapu, a northern island.Acting prime minister Lord Tuita said in a statement that “according to information gathered from Niuatoputapu so far, seven people are confirmed dead, three missing and four with very serious injuries,” Lord Tuita, the acting prime minister, said in a statement. “It is reported that the tsunami did serious damage to the village of Hihifo, which is like the capital of the island.

“The hospital on the island is reported to have suffered major damage; telephone communication has been cut as a result of damage to equipment and facilities on the island; homes and government buildings have been destroyed,” he said.

An airplane was reportedly chartered by Tongan authorities to determine the amount of damage done to Niuatoputapu, but wasn’t able to land.

Noynoy Aquino elected Philippine president

Thursday, June 10, 2010

In the Philippines, the Liberal Party’s presidential candidate Benigno Simeon Cojuangco Aquino III, commonly known as Noynoy, was officially elected as the next President of the Philippines in the 2010 presidential election. The Commission of Elections announced Noynoy’s victory on Wednesday.

He campaigned for an end to corruption and poverty and says he’ll make prosecuting corrupt officials a priority. Noynoy received more than 15 million votes, about 5.7 million ahead of his closest opponent, ousted Joseph Estrada.

Noynoy said in an interview, “I want to lead by example. We talk about corruption. I did make a public vow, I will never steal”. Senate President Juan Ponce Enrile told a crowd after the count: “We have done this … for the Filipino people … This is a historic event.”

He is 50 years old, a bachelor, an economics graduate, a Senator and is the only son of former President Corazon Aquino and former Senator Benigno Aquino, Jr.. Noynoy’s father was shot while in military custody during the regime of late dictator Ferdinand Marcos, before his mother, Corazon Aquino, led the People Power Revolution that toppled Marcos in 1986. She then served as president for six years.

Use Of Leveling Compounds When Installing Ceramic Floor Tile

Leveling compounds are ideal for smoothing out a subfloor surface prior to installing ceramic floor tiles. To ensure your ceramic floor tiles will not crack over time, it is critical that they be installed on a rigid and level subfloor.

Leveling compounds are cement based and are easy to apply. They will adhere well to both concrete and wood surfaces.

When preparing a floor for the installation of ceramic floor tile, additional material is typically installed over the home’s existing base subfloor. The existing subfloor is normally constructed out of concrete, 3/4th inch OSB, or plywood. Concrete, backerboard, or exterior plywood is normally added to the subfloor to increase the rigidity of the floor surface. The more level and rigid the floor, the less likelihood of the ceramic tiles cracking.

To ensure that the floor surface is level and rigid, a leveling compound may be needed, The leveling compound can be added to the floor to adjust for any dips or humps in the subfloor. Dips and humps can occur due to imperfections in the concrete slab or floor joists, or from warping in the base subfloor.

The subfloor should be clean and dust free, prior to applying a leveling compound to your subfloor. If it is not, you may get a poor bond between the leveling compound and the subfloor.

To apply leveling compounds, you can use a trowel, broad knife, and/or a length of 2’x4′.

Use the length of 2’x’4, to see how much leveling compound you will need, by running it over the surface of the subfloor to see how much of a dip or hump you have to deal with.

When making up a batch of leveling compound be careful to not make up too much at any one time. Leveling compounds set up quickly. Consequently, it is best to make up small batches at a time.
