Las Vegas ‘chili finger’ woman arrested

Las Vegas, Nevada – The San Jose Police Department has announced that Anna Ayala, the woman who claims to have found a human finger in a bowl of chili at a Wendy’s restaurant in San Jose, California, was arrested at or near her home in Las Vegas on Thursday evening, in connection with the case.

According to court documents, she has been charged with one count of attempted grand larceny related to the chili case, and one count of grand larceny in an unrelated real estate deal, and is being held without bail in Clark County, Nevada, pending extradition. A press conference by the San Jose Police and Wendy’s was to be held on Friday, April 22, at 13:00 PDT.

Wendy’s had offered a reward of as much as $100,000 for information leading to an arrest in the case. Ayala claimed to have discovered the finger while eating at a Wendy’s on March, 22. Ayala later dropped plans to sue the restaurant after previous lawsuits, including one against another fast food restaurant, were made public.

The charges place the value of the attempted theft against Wendy’s at $2.5 million. The unrelated charge stems from an incident, also in San Jose, when Ayala allegidly received an $11,000 down payment on a mobile home she did not own. Ayala will face an extradition hearing on Tuesday, April 26.

Gunman commits suicide at University of Texas

A man wearing a ski mask and carrying an assault rifle apparently killed himself in the library of the University of Texas in Austin, Texas earlier today.

The university was placed under lockdown and all classes were canceled as a result of the incident. Nobody else was hurt, but police are still looking for a possible second gunman. Art Acevedo, the chief of Austin police, said that officials are also considering the possibility of explosives left by the suspect. Armored vehicles were seen moving around the campus in response to the event, as well as {{w|SWAT team|SWAT teams}, bomb-sniffing dogs, and police helicopters. An ambulance was seen around 9:00 a.m. CDT (1400 UTC) at the University of Texas’ Perry-Castaneda library.

The school’s website included a notice this morning, which read: “The person involved in this morning’s shooting on campus has been confirmed dead on the sixth floor of the Perry-Castaneda Library from an apparent self-inflicted gunshot wound. Law enforcement are searching for a second suspect. If you are off campus, STAY AWAY. If you are on campus, lock doors, do not leave your building.” The gunman was reportedly killed by a self-inflicted gunshot wound, and no shots had been fired by law enforcement officials.

The shooter has not yet been identified, and the reason behind the incident is not yet known. Witnesses described the man as wearing a dark suit and ski mask, and carrying an assault rifle. Randall Wilhite, a professor at the university, said that he heard gunshots while going to class and saw the suspect heading toward the library just after 8:00 a.m. CDT (1300 UTC). The gunman appeared to be firing shots randomly. “When I pulled up in my car, he stood right in front of me and didn’t stop running but turned in my direction, fired three shots into the ground to the left of my car and kept running,” said Wilhite. The gunman had the chance to shoot students, added Wilhite, but he did not appear to be targeting them.

The school, which has around 50,000 students, sent out an alert around that time warning students to stay where they were. Robby Reeb, a senior at the school, said that “a guy sprinted past me screaming, ‘There’s a guy with a gun.’ I looked up and saw a man in a ski mask, wearing a suit, and carrying an assault rifle. And I called 911.”

Police said that the gun used in the shooting was an AK-47, and that they were examining two different crime scenes: where the shots were fired outside, and where the gunman was found dead in the library. Police would not say whether he was attending the university. Chief Acevado said that there were “reports of a second suspect that was wearing a beanie with a long rifle, wearing blue jeans and a black top” that “may or may not be a white male.”

Several hours after the lockdown began, police allowed students to leave the university’s campus, although nobody is still allowed to enter.

The school was also the site of a shooting spree on August 1, 1966, in which university student Charles Whitman fatally shot fourteen to sixteen people and wounded another 32 before being himself killed by law enforcement authorities; reports of the exact death toll are inconsistent. Whitman, a former U.S. Marine, shot students from the observation platform of the school’s tower. That event was the deadliest school shooting in the United States until the 2007 Virginia Tech massacre.

Bayern Munich’s technical director Michael Reschke leaves the club, becomes sporting director of VfB Stuttgart

Yesterday, German football club Bayern Munich announced their technical director Michael Reschke vacated his position. VfB Stuttgart, who announced parting ways with their sporting director Jan Schindelmeiser on Friday, recruited Reschke as their new sporting director.

59-year-old Reschke served as the technical director at the Bavarian club for the past three years, holding the position from July 2014. In an official statement issued by Stuttgart on Friday, the club’s Supervisory Board made a “unanimous” decision to sack their sporting director Schindelmeiser. The board’s chairman Wolfgang Dietrich said, “We regret having to take this step, but we were no longer convinced the implementation of our goals and achievement of agreed targets would be possible with the current personnel constellation. Ultimately, VfB Stuttgart takes top-priority and it is our absolute responsibility to make decisions for the good of the positive development of the club.”((de))German language: Wir bedauern diesen Schritt, waren letztlich aber nicht mehr davon überzeugt, dass die Umsetzung unserer Ziele und der getroffenen Absprachen in der bisherigen Personalkonstellation zu erreichen sind. California senator opposed to cell-phones involved in cell-phone related crash

California state senator Carole Migden crashed her state provided SUV into a Honda sedan while reaching for her phone. Migden has favored a new law penalizing drivers who talk on their cellular phones (aka mobile phones).

The crash occurred on Highway 12 in Solano County, California Friday morning. The driver of the Honda was taken to a near-by hospital for minor injuries.

In 2006, Migden voted to fine drivers a minimum $20 fee for driving while talking on the phone without a hands-free device. The law will not go into effect until July 2008, so she will not receive a fine for using her phone. She said that she has taken full responsibility for the accident.

The California Highway Patrol (CHP) is now looking into reports of another accident involving Midgen.

“We’re getting information now from the officers following up this morning that there was a second accident involving the center divider. Witnesses have her driving to the left of the number one lane and brushing against the guardrail,” said Marvin Williford, spokesperson for the CHP in the Solano area.

TEPCA protests the Taiwanese government on WiMAX in Taiwan

Taiwan Electromagnetic Radiation Hazard Protection and Control Association (TEPCA), an environmental organization set to promote environmental hazard warnings on electromagnetic radiation, protested over the potential health impact of electromagnetic radiation as Ying-jeou Ma, President of the Republic of China, visited this show on the 2nd Day of 2008 WiMAX Expo Taipei (June 3).

“Base stations of WiMAX are unnecessary in Taiwan! The governmental people didn’t care about the living and health of the public!” strongly stated Jiau-hua Chen, Chairman of TEPCA during the protest.

The on-site rate of electromagnetic radiation was firmly higher than the international standards as some experts examined at the showground, according to the Taiwan Hakka Television. In addition, the TEPCA strongly appealed the governments and organizers to announce the place of base stations for health and safety issue.

As a result of the protest, not only the information security, but also environmentalists disputed the future of WiMAX.

Twelve-year journey of Rosetta ends; spacecraft crashes into comet

On Friday, European Space Agency’s (ESA) spacecraft Rosetta ended its mission, crashing into Jupiter-family comet 67P/Churyumov–Gerasimenko. Rosetta is the first spacecraft to orbit a comet; it traveled in space for twelve years and about eight billion kilometres (about five billion miles).

The ESA’s Darmstadt, Germany control centre ceased to receive signals from the spacecraft, confirming the Rosetta mission’s end, at 11:19 UTC. Mission controllers said it was traveling about 90 centimeters per second on impact (two miles per hour), about a walking pace.

Almost two years ago, in November 2014, Rosetta successfully landed a probe called Philae onto 67P/Churyumov–Gerasimenko, with amongst its goals better understanding how the Solar System was formed. Philae’s discoveries included the presence of molecular oxygen and nitrogen on the comet. It also discovered water on the comet which, according to the scientists, had a different distribution of hydrogen isotopes from the water on earth.

The spacecraft studied the gas, dust, and plasma immediately surrounding the comet during its final approach.

ESA’s director general Johann-Dietrich Wörner said, “Rosetta has entered the history books once again[…] Today we celebrate the success of a game-changing mission, one that has surpassed all our dreams and expectations, and one that continues ESA’s legacy of ‘firsts’ at comets.”

Grace E. Kirn sued her husband, Henry Kirn, for divorce, alleging desertion on and cruelty for a considerable period prior thereto. Henry Kirn filed his answer and cross-bill, denying the allegations of the original bill and charging her with desertion and adultery. The trial judge found that the charges had all been established, but dismissed the bills. Appellant husband and appellee wife each sought review of orders of the Law and Chancery Court of the City of Norfolk (Virginia), which dismissed the wife’s bill of complaint for divorce and the husband’s cross-bill, held that it had no jurisdiction to make any allowance to maintain, support, and educate the infant child of the marriage, and directed the husband to pay to the wife’s attorneys a fee for legal services and the costs.

Issue:

Whether the trial court erred in dismissing husband s cross-bill and refusing to award him a decree of

divorce

a vinculo and in excessive attorney fee?

Discussion:

This court held that the doctrine of recrimination applied and operated to bar the divorce action, even though the allegations were proved. The court held that the award of attorneys’ fees was within the discretion of the trial judge. The case had been vigorously contested on both sides, the evidence covered nearly 500 printed pages, and it had been pending for several years. Absent witnesses had to be located, charges and countercharges had to be investigated. It was argued twice in the trial court. In view of those considerations, while the fee appeared to be quite large according to local standards, the court was indisposed to reduce it.

Conclusion:

This court hence affirmed trial court s orders.
